By using the Zbirka website, submitting an enquiry, uploading photographs, accepting payment, or using a Zbirka report, the user accepts these Terms and Disclaimer in full. If the user does not agree with the terms, please refrain from using the service.
Zbirka is a service operated by Marin Kramer-Kelemović, Reykjavík, Iceland, under Marin Kramer-Kelemović's personal kennitala.
Zbirka provides preliminary online opinions, market guidance and PDF reports (Art Appraisal Report – preliminary market-value appraisal of an artwork) for artworks on the basis of photographs and information supplied by users.
The Art Appraisal Report is Zbirka's basic service. The user submits photographs and basic information about the item through the website form. If Zbirka accepts the enquiry and the user makes payment, Zbirka prepares a PDF Art Appraisal Report and sends it to the user's email address.

Zbirka may provide advice relating to buying, selling, transport, sales channels or another specific question concerning an artwork. Advisory is based on information and photographs supplied by the user, as well as available market information and Zbirka's experience.
Art Advisory does not constitute confirmation of authenticity, a guarantee of attribution, legal advice, customs advice, an insurance valuation or a binding market-value appraisal.
Zbirka may suggest possible transport options and draw attention to risks, but accepts no responsibility for carriers' work, customs procedures, insurance or damage during transport.
The price of Art Advisory is 20 € per enquiry. Payment is requested only after review and acceptance of the enquiry. If, for objective reasons, Zbirka cannot provide advice after payment has been received, the user may request a refund.
An online appraisal is limited because the item is not examined physically. A report prepared on the basis of photographs cannot replace:
Zbirka does not issue certificates of authenticity and does not guarantee the artist, school, attribution, period or provenance of the submitted artwork. Any attribution note is a preliminary opinion based on the material supplied. Conclusions may change after an in-person inspection, technical analysis, conservation report or further archival research.
In many cases, reliable attribution requires examination by a specialist, conservator, institution, foundation or catalogue raisonné author, or technical analysis unavailable through an online service.
Any stated value is an indicative market opinion at the time the report is prepared, not a guaranteed sale price. Value may vary significantly depending on condition, provenance, authenticity, attribution, quality, subject, dimensions, market demand, location, sales method, transaction fees, buyer's premium, exchange rate and timing.
Zbirka does not guarantee that an artwork can be sold at the appraised value or that an auction house, gallery, dealer, institution or buyer will accept it at the same attribution or value. Where authenticity or attribution has not been reliably established, the value appraisal may be conditional or indicative.
The user is responsible for the accuracy, completeness and truthfulness of all supplied information and photographs. By submitting material, the user confirms having the right to supply the photographs and item information.
Poor-quality photographs, incomplete information, altered or misleading images may affect the report's content and reliability. Zbirka may request further photographs or information before accepting an enquiry or preparing a report.
Zbirka reserves the right to accept or refuse any enquiry without an obligation to provide a detailed explanation. Refusal may result from insufficient photograph quality, items outside Zbirka's field of work, excessive complexity requiring a specialist or formal appraisal, or supplied material that does not allow a responsible and useful Art Appraisal Report. Zbirka may, but is not obliged to, state a brief reason for refusal.
Payment is requested only after Zbirka reviews the supplied material and accepts the item for preparation of a report, unless otherwise agreed. The basic price for an Art Appraisal Report is 20 € for one artwork, unless a different price is stated on the website or otherwise agreed. Payment instructions are supplied after an enquiry is accepted. Preparation begins after payment is received.
If, for objective reasons, Zbirka cannot deliver the agreed report after payment has been received, the user may request a refund. Once a report has been prepared and sent, a refund is not possible unless required by law or otherwise agreed in an individual case. Payment-provider fees, bank charges, exchange-rate differences and transfer delays are outside Zbirka's control.
Zbirka aims to prepare and send the report within 48 hours of receiving payment. In exceptional cases, for example technical difficulties, a need for further information or other justified circumstances, this deadline may be extended and the user will be informed.
The user may retain, download, print and share the PDF report in the original form received. It is not permitted to alter, edit, remove pages, delete notes and terms, change values or text, or present an altered report as original. It is prohibited to use a report misleadingly, for example to claim guaranteed authenticity or a guaranteed sale price.
Information and photographs supplied by the user are processed solely to handle the enquiry, communicate, prepare the report, keep internal records and complete legally necessary administration. Further information is available in the Privacy Policy.
Zbirka may occasionally consult external experts or refer users to conservator-restorers, art historians, auction houses, galleries or other third parties. Zbirka is not responsible for third-party services, opinions, prices, decisions, fees, websites or conduct. External links are provided for information only and do not imply endorsement or responsibility by Zbirka for content on those sites.
Users may not use the website or reports for the following purposes:
The Zbirka website and service are provided with reasonable professional care, but without a guarantee that the website will always be available or free from technical errors, that every item can be assessed, that every report will meet all user expectations, that a value appraisal will correspond to future sales results, or that third parties will accept an item at the stated attribution or value.
To the extent permitted by applicable law, Zbirka is not liable for indirect, incidental, special, punitive or consequential damages, including lost profit, a missed sale, a lower realised sale price, decisions based on a report, refusal of an item by auction houses, galleries, buyers, insurers, experts or institutions, incorrect conclusions caused by inaccurate or incomplete user data, or damage arising from use of a report for formal legal, tax, insurance, inheritance or court purposes.
The user is responsible for how they use a report and for consequences of misuse, report alterations, false material submissions or unlawful sharing of another person's material. The user undertakes to indemnify Zbirka against any damage, cost or claim arising from breach of these terms or misleading use of a report towards third parties.
Zbirka reserves the right to update, amend, temporarily suspend or discontinue part of the service, prices, website content or process without prior notice, by publishing changes on the website.
Zbirka may refuse, suspend or permanently stop providing the service to a user who breaches these terms, behaves offensively or maliciously, submits false materials or misuses reports towards third parties. In the event of justified termination after payment is received but before a report is prepared, Zbirka will consider a refund.
These terms are governed by the law of Iceland, unless mandatory rules provide otherwise. The court in Reykjavík, Iceland, has jurisdiction over all disputes arising in connection with these terms, unless mandatory rules of the user's country of residence provide otherwise.
The current version of the terms is published on this page and may be updated at any time. Continued use of the service after publication of changes constitutes acceptance of the new terms.
